| 摘 要： | 公法和私法的分类历经千年历史，至今已经深深融入了许多大陆法系国家的法律文化之中。然而随着历史的发展，公法和私法分类的基础开始动摇，在经济社会化的今天，公法与私法的分类的作用不应该被过度地提高，相反，这种分类已经失去其原有的生命力，应该退出历史的舞台。 |
