| 摘 要： | 从本源本体论、马克思主义理论和契约论等典型角度考察,要科学回答“法律是什么”必须把法的内涵和外延辩证统一。强者利益论、主权者命令论和统治阶级意志论以对立“二人模式”探究法律来源,导致立法者与遵守法律无关。借鉴契约论有助于克服统治阶级意志论的缺陷。

| Abstract: | An investigation from the typical angles of ontology,Marxism theory and the theory of contract shows giving a scientific reply to "what is law" must be united the intension and extension of the law dialectically.The theory of survivor's interest and sovereign's order and the theory of ruling class's will ponder the source of the law basing on opposite pattern and result in the legislator's no bearing on observing the law.Drawing lesions form the theory of contract helps to surmount the shortages in the theory of ruling class's will. |
