| 摘 要： | 本文以传统的物权为历史起点,分析了大陆法系立法和理论上对物、财产、财产权的混淆,造成了大陆法系封闭的财产法体系,使得其在知识经济条件下,难以将新出现的财产权利包容.自主知识产权的拥有是一国综合国力的集中体现.因此,我国应建立开放的知识产权体系,全面保护知识产品,提高知识产权的保护意识,增强我国的综合国力.参考文献3.

| Abstract: | Taking the traditional real right as the historical beginning, this paper analyzes the confusion about object, property,and property right in legislation and theory of mainland legal system, which led to the closed property right system of mainland legal system and mgde it difficult to include the newly appeared property rights under the knowledge economy condition. The independent intellectual property is the concentrating reflection of the comprehensive national power of a country. Therefore, we should establish an open intellectual property system to protect intellectual products all-round and increase the protection consciousness and strengthen the comprehensive national strength of our country. 3 refs. |
