| 摘 要： | 中国的社会结构正在逐渐形成一个国家与社会并立互动的二元结构，这就为民间法的继续存在与发挥作用提供了社会条件。由于国家、社会二分而形成的大、小传统的阻隔为民间法的存在提供了化土壤。在处理国家法与民间法的关系上，不是一方对另一方的挤压与消灭，而是在相互尊重的基础上进行理性的对话与沟通。

| Abstract: | A dual construction of nation-society coexistence and intercourse has been forming in Chinese social structure. It supplies a good background for the operating of local law. The traditional separation of big nation and small society gives a culture background for the existence of local law. In dealing with the relation of national law and local law, they both must have a rational communicating without squeezing each other. |
