| 摘 要： | 从一起较具影响力的著作权侵权案涉及的法律问题入手．分析了期刊全文电子数据库的含义及其涉及的著作权问题；对涉及的著作权集体管理制度的起源、我国立法现状和实施现状进行了介绍．初步探索了有关著作权集体管理组织的性质、著作权人与著作权集体管理组织之间的关系、著作权集体管理组织实施的管理行为的对外效力等问题。
