| 摘 要： | 宪法是人民契约的产物,是国家权力存在的合法性依据。宪法权利是利益的综合保障权,是“合法”、“合理”、有效的法律权利。因此,宪法赋予了每一个公民参与法治社会的基本的“行为可性”相对公民而言“宪法权利”基本价值属性是“法治性权利”。
