| 摘 要： | 在世界的角落一直都存在着这样的秩序:人们无需法律的调整,只是依据日常生活的习惯来解决彼此的"恩怨"。在法治时代到来之时,我们也不应忽视这种秩序的存在,而应思考这种秩序存在的原因,并以此改进立法,使法律具有更多的实效。
