| 摘 要： | 儒学体现的人文关怀与西方传统的人文主义有着重大区别.法(刑法)蕴涵着公正、人权保障、人的自由、人道关怀等丰富的人文价值.现代意义上的法及无罪推定等基本原则是以西方传统的人文主义为理论根基.但在当代,尤其在我国法的价值构造中,比照儒家的人性论、文化观来阐释法及其基本原则的基本价值,能够弥补西方各种传统阐释中存在的缺失,能够更好地应对西方各种传统阐释所面临的合法性危机.

| Abstract: | The humanistic care embodied by Confucianism is quite different from the traditionalwestern humanism. The law contains such humanistic values as justice, safeguarding of human rights,freedom and humanistic care. The law in the modern sense and the fundamental principles such as infer-ence of being not guilty are founded theoretically on the traditional western humanism. It should be not-ed, however, that in the value construct of the laws in China today, the Confucian humanism and its viewof culture can make up for the deficiencies in the traditional western interpretations, and therefore canbetter cope with the legal crises in the traditional western interpretations. |
