| 摘 要： | 量刑问题通常被学界视为刑法理论的缩图，在英美，量刑更是刑事法官最重要的一项工作，李斯特曾把刑罚裁量权视为法官在黑暗中摸索的偶然与随心所欲的决定。立法活动追求公正的一般化，而司法活动体现了个别公正，那么，在量刑活动中，法官的自由裁量权如何作用才能达到量刑的最大公正呢？

| Abstract: | Sentencing issue is usually regarded as the thumbnail of the criminal theory,especially in Britain and the United States,where sentencing is the most important job for a judge.Legislative activities reflect the general pursuit of justice,while justice activities reflect the individual justice.And the question raised herewithin is how to arrange the judge's discretion to achieve the maximum of justice in the course of sentencing. |
