| 摘 要： | 在社会主义条件下，法治与人治的对立，主要表现为法律与领导个人的意志之间的对立。邓小平在总结历史经验教训的基础上，不但提出了主张法治，反对人活的思想；而且还深刻地阐明了法治的内涵，及其与人治的严格区别。有法可依，有法必依，执法必严，违法必究，既是法制的实现形式，也系统地表明了邓小平法治思想的具体内容。

| Abstract: | In the socialism society, the conflict between ruling by law and by individual mainly reflecting on the conflict
between the law and the thoght of the ruler. By summarying the historical experiance, Deng Xiaoping not only puts forward the thought on ruling by law against by individual, but also deeply clarifies the essence of ruling by law and the strict difference from ruling by individual. Available laws, depending on the laws, strict implemanting the laws, punishing in alliance with laws, which is the realization of ruling by law, and also states the specific content of Deng Xiaoping's thought of ruling by law. |
