| 摘 要： | 海峡两岸虽在文化上同宗同源,但宪法解释制度却存在极大差异。在此情况下,对两岸现有宪法解释制度予以比较,进而探寻大陆现行宪法解释制度的不完善之处,或许可为完善释宪制度工作提供理论上的启发。对比海峡两岸不同的释宪主体、客体、释宪程序、解释的形式和解释的效力,我们可以清楚地看到,台湾地区的释宪制度远比大陆要成熟和完善。究其原因是多方面的,但最为根本的一点就是大陆的宪法并未真正在司法审判中得到适用。当然,我们借鉴台湾的释宪制度并不能照搬,而是从中得到启示。
