| 摘 要： | 微博反腐是网络反腐的一种重要形式,公民以微博作为反腐言论的重要发表平台,对国家机关的日常权力运作和出现的腐败问题行使着监督权。但微博反腐作为一种新兴事物,还面临着诸如网民言论非理性、权威性和代表性缺乏、相关法律法规不健全等诸多矛盾和问题。因此,在建立健全网络反腐制度的大框架下,应构建针对微博反腐的相关法律规制,保护公民言论自由的宪法权利,同时对大型微博网站强化管理和教育,扭转政务人员对待微博上网络舆情民意的观念,使得微博反腐能够实现常态化、程序化、规范化,并将这一反腐力量更充分地吸收进我国反腐体系之中。

| Abstract: | The anti-corruption through microblogging is a form of anti-corruption. People take the microblog as an important platform to supervise the daily operation of government and the corruption. The microblogging anti-corruption is facing many inevitable problems,such as the netizens＇ opinion is unrational and lack of authority and representation. Therefore,we should build the legal regulation for microblogging anti-corruption to protect citizens＇ constitutional rights of freedom of expression At the same time,we should strengthen the microblog websites＇ control and make the microblogging anti-corruption become normalization,routinization and standardization. |
