摘    要:民办教育法律规范是教育法学学科发展中重要的研究议题。1997-2002年,推动民办教育立法是 学者的共同呼声。2003-2010年,学者们对民办学校的法律地位、“合理回报”与“分类管理”、民办学校监管 与治理进行了学理探讨。2011-2019年,“分类管理”何以可能成为学界的关注焦点。已有研究对民办教育 法治进程具有推动作用。未来的民办教育法律规范研究应置于民办学校发展的复杂情境,吸收借鉴法学学 科的研究方法,合理确定研究主题。

Abstract:The legal norms of private education are an important research topic in the development of educational law. It had been the common voice of scholars to promote the legislation of private education from 1997 to 2002. Scholars had discussed the legal status, "reasonable returns" and "classified management", as well as supervision and governance of private schools from 2003 to 2010. How to realize "classified management" had become the focus of attention in the academic circles from 2011 to 2019. These studies have promoted the legalization process of private education. It is suggested that future studies on the legal norms of private education should be placed in the complex development context of private schools, borrow from the research methods of law discipline, and determine research topics reasonably.
