| 摘 要： | 自然法的发展史也是一部人类权利的发展史。自然法与正义观念密不可分。在权利观念的形成过程中,西方的正义观念作出了不可磨灭的贡献。在中世纪以前,权利观念体现于自然法"各守本分,各司其职"的神的正义观念之中。这样的权利观念只能是义务本位的。随着人文主义的兴起,自然法带领着人们寻求自然的正义,指引着西方权利观念向权利本位的转换。这样最终才诞生了现代意义上的权利概念。

| Abstract: | The development history of Natural Law is also a development history of mankind's right.Natural Law and justice idea are inseparable.In the formation process of right idea,justice idea in the western makes the indelible contribution.Before Middle Ages,right idea embodies in God's justice idea of Natural Law which is each know one's place,each attends to his own duties.This kind of right idea must be the obligation standard.Along with the rise of the humanism,the natural law leads people to look for natural justice and guides the western to divert right idea toward right standard.So in the end just the right concept of modern meaning was born. |
