| 摘 要： | 随着住房商品化的迅猛发展，建筑物区分所有已成为我国城市居民最普遍的住房所有形态。区分所有人在对单元房享有权利时，对屋顶平台的共有部分也享有共有权。对屋顶平台的利用，应由全体区分所有权人依合法方法使用，实践中的做法与法律规定产生冲突，导致对屋顶平台的利用并不充分。因此为了开发屋顶平台的商业利用价值，可以通过设定专用权的方式充分合理利用屋顶平台。

| Abstract: | With the rapid development of the commercialization of housing, building differentiation possession between urban residents in China has become the most common form of housing differentiation. Residents can claim the rights of the flats as well as the parts of common ownership like the flat roof. At present, the utilization of the flat roof should be based on the rights of all possessors. However, the utilization of flat roof in practice is quite different from what is prescribed in laws, and the flat roof has not been utilized sufficiently. Therefore, for the commercial development of flat roof, we can utilize the flat roof sufficiently by establishing the exclusive right to certain residents. |
