| 摘 要： | 从古代社会向封建社会的过渡过程中,欧洲社会出现了城市和产生了城市法.城市的兴起有经济、社会、政治、宗教和法律等多种因素,而城市法及其观念则是最内在的因素.促进城市法产生在于城市的管理制度,即商人自由与司法独立,以及城市的特许地位,这是法律发展的特别道路.城市法具有共有特征、世俗特征和宪法特征.城市法的基本制度、理论和思想,对近代西方法治有重要的启示作用.
