| 摘 要： | 防果中止是指犯罪人主动有效地防止犯罪结果发生的犯罪停止形态。它是否只适合结果犯?对此问题的不同回答直接影响对犯罪人的刑罚裁量。本文从防果中止成立的条件以及立法、刑罚的目的等方面进行分析，认为防果中止应适合一切有犯罪结果的犯罪，这既能给犯罪人悬崖勒马、回头是岸的机会，又有利于防止犯罪人铤而走险给法益造成不必要的侵害。

| Abstract: | Discontinuation of consequence prevention refers a form of criminal discontinuation in which an offender prevents the criminal consequence voluntarily and effectively during the course of committing a crime. Whether is it only applicable for the consequential offense? The different answers to the problem directly affects the measurement of punishment for an offender. The article thinks that discontinuation of consequence prevention should be applicable for all the offenses with criminal consequence by analyzing from the aspects such as conditions of establishment of discontinuation of consequence prevention, legislative purpose and target of punishment.Such applicable scope can not only make contributions in giving an offender good opportunity to stop committing a crime and to be a normal citizen again, but in preventing an offender from violating legal interest regardless of any results. |
