| 摘 要： | 随着国内和国际经济贸易交往日趋频繁，情势变更不可避免的发生，但我国目前却没有任何法律对情势变更原则的适用作出具体的规定。我国《物权法》已经颁布，《民法典》的制定也是势在必行。《合同法》最终没有规定情势变更原则，这是一个遗憾。我国有确立情势变更原则的必要性和可行性，建议民法典填补这一遗憾。

| Abstract: | With more and more frequent trading between China and other countries, frustration of purpose occurs inevitably without concrete stipulation in any laws in our country.Since the Law of Property Right has been issued and the Civil Code is to be stipulated,it's a pity that there is no stipulation of principle of frustration of purpose.The author here discusses the necessity and feasibility of stipulation of it. |
