| 摘 要： | 我国现行《国家赔偿法》是1994年5月颁布、1995年1月1日起实行的。该法的颁布和实施，是我国民主和法治建设过程中的一件大事。它标志着我国人权保护的一个新时代的开始。但由于我国的国家赔偿制度起步较晚，受历史传统观念习惯及立法体制等方面的影响，《国家赔偿法》在实施中存在一些缺陷，其主要表现为：赔偿的归责原则单一；赔偿标准过低；赔偿程序不合理；赔偿费用支付存在漏洞等。本文针对《国家赔偿法》的上述缺陷提出了相应的完善建议。

| Abstract: | Our country's existing National Compensation Law was enacted in April, 1994,and put in force on January 1,1995.Enactment and implementation of this law is an important issue in the process of the construction of democracy and legal system in our country.It indicated that China has entered into a new era of human rights protection.However,because the national compensation system of our country started relatively late,with the influence of historical tradition,notion,custom and legislative system,etc.The National Compensation Law appears some flaws in the process of implementation,its main performance is sole compensating principle,quite low compensating standard,unreasonable compensating procedure,payment of damages existing loophole and so on.This article proposes some suggestions in view of above-mentioned flaws of National Compensation Law. |
