摘    要:国际体育仲裁院在里约奥运会上首次设立了反兴奋剂特别仲裁庭。此举为国际体育仲裁院建立专门反兴奋剂奥运会体育仲裁制度开创了先河,在奥运会体育仲裁史上有里程碑意义,同时可预示奥运会体育仲裁的发展方向。基于对反兴奋剂特别仲裁庭的仲裁规则、裁决案件和设立动因的分析,对其存在的问题进行剖析,以此探析奥运会体育仲裁的发展方向及该机制对我国体育仲裁制度的启示。

Abstract:The ad hoc Division of the CAS was created by the International Council of Arbitration for Sport in time for the 1996 Summer Olympics in Atlanta. The system of ad hoc Divisions was established for the purpose of resolving the sports disputes in Olympic Games in a fast, fair and economic way. From the beginning, ad hoc Division acted as a multifunction arbitration body, it shall be responsible for all disputes which shall be submitted to ad hoc Division. However, the cases need more professional arbitration proceedings in practice, especially when a large number of doping-related disputes took place before the Rio Olympic Games. Therefore, the CAS Anti-doping Division was established in Rio Olympic Games for the first time. It was significant in the history of Olympic arbitration. This paper studied the Arbitration Rules applicable to the CAS Anti-doping Division, the cases registered by CAS Anti-doping Division, the purpose of the creation of Anti-doping Division, the problem existed in the system of CAS Anti-doping Division and the development of Olympic arbitration.
