国外高校校生关系理论发展和冲突救济演变的借鉴意义

摘    要:代理父母地位说和特别权力关系理论曾分别是普通法系和大陆法系国家高等学校校生法律关系的两种具有代表性的理论.这两种理论随着社会的发展由盛而衰或不断演变,在实践中对校生冲突的司法救济产生了重要影响.揭示国外校生法律关系发展历程,探寻校生冲突救济的演变规律,对于我国高等学校校生冲突的救济有着重要的借鉴意义.

Abstract:The "in loco parents" doctrine and the theory of special power relation was once the representative theories for the student-university relationship at colleges and universities in the common law and roman law country. The ebb and flow of the two theories along with the development of society has given important influence on the judicial relief of student-university conflict. Announcing the development course of student-university relationship and the development rule of student-university conflict relief abroad will have important reference to our country.
