| 摘 要： | 公立高等学校作为全人类创造知识、传播知识、推动民族进步、促进人类文明及其社会发展的基地,它的主体定位历来都是学术界争议的焦点之一。在不同性质的法律关系中公立高等学校却被赋予不同的主体地位,定位的不同使自治权的权限模糊,所以应当以教育法体系的社会法定位,以公立高等学校追求目的,以确立为社会法的主体必要性为视角来确立公立高等学校主体性质,从社会法的角度对公立高等学校的主体进行合理定位。

| Abstract: | The subjectival status of public higher educational institutions has been one of the hot issues academically.It is multifariously defined in different legal relationships,which blurs the autonomy boundary of the educational institutions.Therefore,we need a unified definition for the subjectival status of public higher educational institutions.The definition should be made from the perspective of social laws considering the purposes of the institutions and in the framework of the education law. |
