| 摘 要： | 有些犯罪行为往往造成多重危害后果,既给被害人造成了经济损失也使其精神受到损害。然而依据我国目前的法律规定,受害人对犯罪行为提起的精神损害赔偿无法得到法律上的支持。相关的规定在立法上互有矛盾,并且缺乏理论依据。在实践中也不利于保护受害人的合法权益。因此,应该确立刑事精神损害赔偿制度。

| Abstract: | In the system of market economy, enterprises do not have nothing to do with the government. In face of market competition, some enterprises take moral risks to produce negative products from the urge of profit, which brings too much harm to the people and the society. As our country is changing from the system of planned economy to that of market economy and the development of the market economy is not mature, the government has responsibility and obligation to watch and control the behavior of enterprises . However, what we see is the poor watch of the government. How do the government watch and control？ In this paper, the author puts forward some measures to solve this problem from theoretic and practical directions;Our government should constitute relevant laws, standardize business, enhance force of punishment, and especially pay a great attention to the process and methods of supervision. |
