| 摘 要： | 研究目的]英国最初禁止通讯截取所获情报材料作为证据使用,但是2016年却通过例外规定大规模地促使通讯截取所获情报材料向诉讼证据转化,探究其转化的缘由对于平衡国家安全和个人自由具有重要意义。研究方法]运用规范分析、文献分析方法,探究英国通讯截取所获情报材料之证据使用的立法原则与例外、转化难题、立法演进以及生成逻辑。研究结论]英国通讯截取所获情报材料转化为诉讼证据的根本原因是为了抵制严重侵犯人身自由的反恐措施,而公共利益豁免制度和特别律师制度则为反恐情报的证据转化提供了重要的制度性保障。这对我国技术侦查所获反恐情报材料的证据转化具有重要的镜鉴意义。

| Abstract: | Research purpose]The government in UK initially prevents the intercepted material from being used as procedural evidence.However,the intercepted material is permitted to convert into evidence through the exceptions in 2016.Study on the reasons of the conversion will benefit the balance of national security and individual liberty.Research method]The paper expounds the using principle and exceptions,transformation problems,legislative change and main reason of conversion of intercepted material by means of normative analysis and literature analysis.Research conclusion]The most important reason why Britain transforms intercepted material into criminal evidence is in order to resist the counterterrorist measure which seriously violates persaonal liberty.Public interest immunity and special advocate provide the vital systematic safeguards for the conversion,which offers beneficial reference to our country's evidential transformation fom antiterrorist intelligence gained from the technical investigation. |
