| 摘 要： | 研究目的]专利审查高速路是专利审查国际协作的一种模式,通过合作审查以提升全球专利申请量激增情形下的审查工作效率。研究方法]通过数据对比分析专利审查高速路的运行效果以及对于COVID-19疫情影响的反应,以期为明确我国参与专利审查国际协作的政策方向提供参考。研究结论]专利审查高速路的专利审查国际协作模式能缩短审查周期、提升授权率、减少专利审查意见次数和缓解审查积压。虽然COVID-19疫情对全球的专利审查工作带来了负面影响,但是专利审查国际协作模式能较好的抵御COVID-19疫情带来的风险。专利审查高速路基本上维持了专利国际申请在全球范围内审查的稳定性,并在部分国家持续提升了专利审查工作的效率。对此,我国应推动参与专利审查国际协作制度的建设和发展,为中国企业的海外发展提供制度支持。

| Abstract: | Research purpose]The Patent Prosecution Highway is a model of international cooperation in patent examination via cooperation examination to improve examination efficiency under the global patent application boom.Research method]Through data analysis and its response to the impact of COVID-19,performance of the Patent Prosecution Highway is revealed,so as to provide reference for the policy direction in international cooperation of patent examination for China.Research conclusion]The patent prosecution of international cooperation model,such as patent prosecution highway,can shorten the examination period,increase the rate to be authorized,reduce the number of office actions and ease the backlog of prosecution.Although COVID-19 has had a negative impact on patent prosecution worldwide,the international collaborative model of patent examination is able to withstand the risks caused by COVID-19.Patent Prosecution Highway basically maintains the stability of patent persecution from international patent application in the whole world and continuously improves the efficiency of patent examination in some countries.Therefore,China should promote the construction and development the international cooperation system of patent prosecution and provide institutional support for the overseas development of Chinese enterprises. |
