| 摘 要： | 保护私有财产载入宪法作为新中国制宪和修宪历程中的一件大事,与邓小平的历史贡献及其影响密不可分。邓小平在领导中国改革开放的伟大实践中,支持农村改革,保护个体工商业者;允许部分人先富,使私营经济合法化;突破左倾阻碍,消除私营企业主疑虑;为私产保护入宪奠定了坚实的实践基础。在新的历史阶段,党和国家顺应国情民意,将私产保护载入宪法。改革开放以来中国私有财产发生发展的曲折历程及其法律地位的巨大变化,既渗透着邓小平资本主义观的鲜明个性及对中国私产保护入宪的独特贡献,又反映了私产保护的大势所趋与大国兴起的必由之路。

| Abstract: | In the course of drawing up and amending China's constitution since 1949,the protection of private property has been closely related with Deng Xiao-ping's contributions.In the great practice of reform and opening-up,Deng Xiao-ping supports the rural reform,protects the individual business,lets some people get rich first,makes private sector of the economy legalized,breaks through the obstruction of "Left" opportunism,and clears up suspicions of the individual business.What Deng does complies with the will of the people and with the historical trend of the times,making the protection of the private property written into China's constitution. |
