| 摘 要： | 目前,在对农村土地征收或征用过程中存在着诸多问题,主要原因之一是由于农村土地所有权主体缺位和虚化造成的。我国相关法律法规对农村土地所有权主体的规定相互矛盾,前后不一致,理论和实际脱节。农村土地集体所有权主体应该是农村某一区域或社区内以土地为主要生产资料、成员覆盖该区域全体成员的一个集体经济组织。这个区域可大可小,目前以自然村较为合适。这个集体经济组织既有别于村委会,也有别于农村的其他各种经济组织。

| Abstract: | At present, there are lot of problems in the rural land collection and expropriation. One of the main problems is the confused land ownership as the relative laws do not have a clear definition and some of them are even incompatible. The principal part of the rural land ownership should be a collective economic organization that land is used as their main produc- tive material and the members cover the entry membership in the area. The size of the area can be either big or small; nowa-days the natural team division is a better way for the area. And this kind of collective economic organization should be different from a village committee and the other forms of rural economic organization. |
