浅析消费者概念的法律完善

摘    要:从现行法律意义上讲,"消费者"应该是为个人的目的购买或使用商品和接受服务的社会成员。但现实生活中不断出现有别于法律规定的新的消费购买形式,与传统意义上的"消费者"定义不同。我国《消费者权益保护法》中关于"消费者"概念的界定已日益凸显出弊端,因此有必要对之进行重新界定并加以完善。文章通过对"消费者"概念的比较与分析,进一步分析"消费者"概念存在的缺陷,提出"消费者"概念界定的三方面修正建议。

Abstract:From the existing legal sense, the"consumers'are social members who purchase goods and receive services for personal purposes. But in real life always emerge new forms of consumer purchases, which are different from traditional" consumers"definitions. China's"Consumer Protection Act"on the"consumer"definition has increasingly brought about the shortcomings, so it is essential to be re-defined and improved. The essay further analyzes the defects of"consumer"concept and proposes three pieces of amendments through the comparison and analysis on the concepts of "consumer".
