| 摘 要： | 学位论文全文电子数据库区分为商业性数据库和非商业性数据库,数据库建设者面临学位论文作者发表权、信息网络传播权等著作权困扰,实践中几种克服著作权困扰的途径都有欠缺或不完全具有合法性。建议完善现行法律,引入延伸性集体管理制度或特许性法定许可制度。

| Abstract: | The academic thesis database is divided into commercial database and non-commercial database. The database builder faces a great deal of copyright problems, such as the right to issue, the right of communication to the public online. In practice, the several ways of overcoming copyright problems are not totally legal. We should perfect current law, introduce the extensive collective administration or the licensing legal permit system. |
