| 摘 要： | 法律、法规没有明确禁止农村宅基地使用权自由流转,但由于相关法律、法规条款表述模糊和政策限制,农村住宅的流转风险很大。建议国家制定《农村房地产管理法》,这样既可以促使农村宅基地和住宅的有序流转,又可以保护和合理利用珍贵的土地资源。

| Abstract: | In current laws and regulations it is not clearly forbidden to transfer the right to use the site of a house freely in the country. But due to the ambiguity of some relevant items and the restrictions of certain policies, it takes great risk in transferring the house in the country. It is proposed to formulate "National Regulations for the Country Real Estate Management", which will not only guarantee to transfer the site of a house and the house in order, but also protect and make good use of our land resources. |
