| 摘 要： | 经济体制转变、经济危机、妇女劳动意识觉醒等社会变革对妇女劳动权益保障提出了新的挑战。因此，应对我国妇女劳动权益保障立法进行反思；同时，借鉴域外先进立法模式，从法的效能角度出发，以社会性别为视角，结合女性劳动权益的自然保护和社会保护，建立社会性别影响评价制度，明确法律责任，消除立法中的性别盲点，以更好地保障劳动权公平，促进社会和谐发展。

| Abstract: | Labor right is the core issue concerning females'life and development.And it's facing the challenge of social reforms including the transformation of economic system,the influence from economic crisis and the women's labor conscious.An improvement of relative legislation to better guarantee the female's labor rights in the view of social gender by commenting and analyzing the protection of female labor's rights and exploring the foreign legislative model was proposed. |
