| 摘 要： | 关于故意杀人罪和交通肇事罪，本文主要围绕三个问题进行分析：交通肇事后逃逸而致人死亡的行为人在主观上能否出于故意；逃逸致人死亡案件中交通肇事的先行行为能否引起作为义务；交通肇事罪中“因逃逸致人死亡”是否可以成立不作为的故意杀人罪。
