| 摘 要： | 《顺直临时省议会法》是顺直临时省议会于1912年7月议决通过的直隶地方议会法，该法采用了立法权高于行政权的分权模式。但直隶都督认为议会权力过大，拒不公布施行。议会与都督围绕《顺直法》展开了较量。1913年4月，北京政府公布了全国统一的《省议会暂行法》，大大削减了议会的权力。《顺直临时省议会法》之争表面上是法律问题，实际是政治问题法律化的体现，是民初由集权向分权政制转型初期，新生的利益集团与传统的既得利益集团在权力和利益再分配中的政治博弈。

| Abstract: | Temporary Law of Shun-zhi Parliament is the law formulated by Shun-zhi temporary parliament in July 1912,using a model legislative power higher than executive power.But the governor of province refused to publish and criticized that legislative power was too great.In April 1913,Beijing government announced a unified national law of parliament,greatly reduced the powers of the parliament.The dispute about the law of parliament is a legal issues apparently,in fact,it is a reflect of political issues.It is a political game between new and traditional interest groups. |
