| 摘 要： | 为了保证信息的畅通，有必要以法保护不具创造性（不同于著作）的数据库。欧盟于1996年3月颁布了“给数据库单独权利”的指令（简称：EC指令），并要求加盟各国实现国内立法化。美国则倾向不用立新法，而用已有的“不正当使用”条款来处理．日本则倾向用“不公平竞争法”来以法保护不具创造性的数据库，而对“欧盟指令”不太感兴趣．

| Abstract: | A new legal system which has a proper balance between protection of non-original databases and smooth now of information is needed. In Match 1996. Eu adopted ixrective which took Sui generis right approach, on legal protection of databases and member states are implementing the ixrective into national law. US took an new misappropriation approach changing from Sui generis right appproach. In Japan the discussion about legal protection of non-original databases has just started. No consensus has yet formed on the idea of protection of investment which is fundamental in EC Urective Sui generis right approach and unfair competition law approach is rather gaining in power. |
