| 摘 要： | 随着中国进入汽车社会，交通事故频发，由此引起的社会问题令人惊心。由于酒后驾驶、醉酒驾驶所致事故比例高、危害大，引起了广泛关注，酒后驾驶、醉酒驾驶“人刑”也得到了社会大众和部分学者的支持。但根据刑法谦抑性理念和我国现行法律法规，控制酒后驾驶、醉酒驾驶的其他手段并未穷尽，“入刑”既无必要，也无济于事。
