| 摘 要： | 大学章程在大学的建设与发展中具有举足轻重的作用。我国大学章程在制定与实施的过程中存在着法律地位不明确、缺乏程序性规定、可操作性不强等诸多问题。针对上述问题,高校在大学章程的制定与实施中应当坚持以下原则：提高对大学章程的认识,明确大学章程的法律地位;明确大学内部各权力关系,凸显学术权力在章程中位置;进一步明确教师与学生的权利与义务;规范章程用语,增强可操作性;遵循合法的程序制定章程;建立监督机制,提高大学章程的公开性和透明度。

| Abstract: | The university constitution has played an important role in the university＇s construction and development.There are some problems existed in the formulation and implementation of China university constitution.Such as： the legal status is undefined,lacked of procedural provisions and the operability is not enough.In response to these problems,the university should uphold the following principles in the formulation and implementation of the constitution： raising the awareness of the university constitutions,clear the legal status of university regulations;clear the relations of university＇s internal power,highlighting the position of academic power in the constitution;further specific the rights and obligations of teachers and student;standard the constitution terms and enhance the maneuverability;follow the legal procedures to establish the constitution;establish the monitoring mechanisms to improve the openness and transparency of university constitutions. |
