虚假广告现象研究

摘    要:虚假广告泛滥已成为一大社会公害。虚假广告通常分为欺骗性虚假广告和误导性虚假广告,具体表现又分为多种情况。导致虚假广告产生和泛滥的主要原因是广告主、广告经营者、广告媒体遵守广告法规意识淡漠,出于各自的利益驱动,没有把好广告的创作关和发布关,广告监管部门对虚假广告监管不力,惩处不力,同时广告法规体系与执法体系也很不健全。要想治理虚假广告泛滥,必须抓住上述主要矛盾,加大对虚假广告的查处与惩治力度,提高广告监管效率。

Abstract:The overflowing of false advertisements has been a social environmental damage.The false advertisement usually is divided into the fraudulent false advertisement and the misleading false advertisement,and its concrete manifestation is of many kinds of situations.The reasons that false advertisements' producing and overflowing are as following: Firstly,the advertisement host,the advertisement operator and the advertisement media do not have enough legal consciousness,so they have not undertaken the responsibility of advertisements' creation and issue respectively for theirs benefit;Secondly,advertisement surveillance department supervises and punishes the false advertisement insufficiently;Thirdly,The advertisement legal framework and the law enforcement system are not very perfect.In order to govern the false advertisement,we must hold the above principal contradictions and enlarge false advertisements' investigation and punishment to enhance the advertisement supervising and managing efficiency.
