| 摘 要： | 国家赔偿法修正案草案前不久终于迎来了全国人大的首次审议，从草案可见，将精神损害纳入赔偿范围是这次国家赔偿法修改的核心内容之一。建立和完善我国精神损害行政赔偿制度正是当务之急。本文应用案例分析方法，分析了现阶段我国立法中精神损害行政赔偿制度缺失给行政相对人带来的救济缺失，论证了我国构建精神损害行政赔偿制度的必要性，提出了建立和完善我国精神损害行政赔偿制度的几点设想。

| Abstract: | The draft of State Compensation Law Amendment was considered finally by National People＇ s Congress for the first time recently. From the draft, it can be seen that including compensation of administrative spiritual tort in administrative compensation system is one of the cores concerning State Compensation Law Amendment. Establishing and improving the system of administrative compensation for moral damage is a matter of urgency. In this paper, useing case study methods, the authors analyzed relief missing for victims because of the lack of today legislation of administrative compensation for moral damage, demonstrated essentiality of Establishing the system of administrative compensation for moral damage, and proposed some ideas about it finally. |
