摘    要:商品房认购书在法律性质上属于预约合同,具有法律拘束力,当事人应在此后尽最大努力的诚信承担谈判义务,公平合理地确定彼此的权利义务,以缔结正式的商品房买卖合同。如有违反,应承担强制履行、恢复原状、损害赔偿等法律责任。

Abstract:The commercial house subscribing-warrant belongs to order-contract in its nature and bonds the relevant parties. The parties should try their best to negotiate and determine their rights and duties reasonably, in order to conclude a formal commercial house transaction agreement.Otherwise,the breaching party should be responsible for the legal liability such as enforcement,recovery,compensation and so on.
