摘    要:《宪法》规定我国城市土地属国家所有,但是国家土地的所有权如何才能在经济上实现,如何才能实现这一资源配置上的效益最大化?城市土地国家所有权与经营权应适当分开,成立国有土地投资经营公司,全面负责营利性的土地经营。城市土地使用制度改革的焦点问题是产权的转让,在理论和实践上探索所有权与经营权的适当分开,以及产权市场的架构和管理,对于深入改革城市土地开发和利用有重大的理论和实践意义。

Abstract:The Constitution of PRC stipulates that urban land is owned by the nation, but the way how to realize the land' s ownership economically and how to maximize the benefit of resource allocation is worth studying. The thesis puts forward that the land' s ownership and management fight should be separated, and state - owned company of land investment and management in charge of profitable land management should be set up. The focus problem of the reform of urban land utilization system is the transfer of property right. The research on the separation of owner-ship and management right both theoretically and practically and on the framework and management of property fight market is of great theoretical and practical significance to the reform of urban land development and utilization.
