| 摘 要： | 在我国土地政策的历史演变过程中，土地所有权经历了归农民所有、收归国有，再到当前主要表现为家庭联产承包责任制。目前，土地承包经营权重归农民凸显出新的矛盾，并对社会造成一定的不利影响。为解决当今形势下的矛盾，土地所有权的归属需要重新确权，土地产权确权归农民，所有权的确立是保障财产的必要条件。
