| 摘 要： | 文章结合我国相关法律规定对商品房预售所出现的一些法律问题进行探讨.首先阐述了商品房预售合同的法律性质和特征,然后对商品房预售存在的主要问题,如国家税收政策调整产生的成本分摊和房屋按揭贷款不能时商品房买卖合同的解除等,进行了分析与论证,并就解决办法提出了自己看法.
