| 摘 要： | 在"中国古代只有公法(刑法)没有私法(民事法)"等观念的影响下,法律史学界的契约研究也呈现出"国家"缺席的状态。但通过对清代各类法律文献想梳理和契约文本中透露出的信息,我们可以看到,清代不仅制定了详细的和对不动产买卖契约有重要关联的契税制度,而且国家法律对不动产买卖契约的主客体资格、契约的书面规范等都有细致的规定。这些契约规范也和其民族立法精神、治吏思维存在千丝万缕的联系,具有强烈的"公法"色彩。

| Abstract: | Influenced by the concept that in ancient China,there were no private laws(civil law),but only public law(criminal law),"state" was absent from the researches of contract in the field of law history.However,from the information revealed in various legal documents and contract texts,we can see that there were not only detailed contract tax system related to estate,but also very detailed regulations about the qualification of the contract subjects and objects,and the regulations about the format of written contract.These contract regulations were closely related to the national legislating spirit and the management of officials,which has the heavy color of criminal law. |
