| 摘 要： | 责任政府是法治政府的前提,行政侵权责任主体制度是行政责任制度中一个十分重要的问题。我国现行行政侵权责任主体制度存在着较大缺陷,应在借鉴西方法治发达国家行政责任主体制度经验的基础上对我国现行的行政责任主体制度进行改良,其关键是:当行政公务人员违法行使职权侵犯公民、法人或其他社会组织的合法权益,且主观上存在故意或重大过失时,应由该公务人员个人承担侵权法律责任,国家仅承担补偿责任。

| Abstract: | Duty government is the premise of legal government.The duty of administrating tort subjects system is a very important problem in administrative duty system.Now there is a big bug in our present duty of administrating tort subjects system,so we should improve our system on the basis of the western developed countries,whose key is,when the administrators use their rights to violate the citizen＇s legal rights and benefits illegally with a subjective purpose of important negligence,the administrators themselves should assume all of the legal responsibilities and the country only bears the compensating duty. |
