| 摘 要： | 埃里克森认为,法律仅指由政府发布的组织规则;相对于法律,其它规则如个人伦理、合约、社会规范和非政府组织规范等都称为非正式规范.作者通过实证调查发现,有了法律,法律之外的社会规范不仅没有消失,反而深刻地检验着法律.而处于转型期的中国,法律日益增多,同时,社会规范也广泛存在,形成不同层次的"无需法律的秩序".法律与社会规范都能起到维护秩序和社会稳定的功能,但是二者具备自身优势的同时又都有其局限性,文中关注法律与社会规范在我国社会运作中互动和协调的深层动因,力求在达到平衡的基础上促进二者各自社会功能的实现.
