摘    要:随着我国经济的快速发展,越来越多的农村人口涌入城市寻求谋生的道路。而城市有限的土地无法满足逐渐增长的人们的需求。因此,人们把目光投向了农村或农村与城市交界处的小产权房。正是由于小产权房价格低廉的特点,使小产权房的规模不断扩大,小产权房的转让合同也屡见不鲜。小产权房并没有国家规定的三证齐全,其使用者并没有取得小产权房的所有权。所以,有必要对于小产权房转让合同的效力进行探讨。

Abstract:With the rapid development of Chinese economy, more and more people in rural area move into cities to seek for better live. Limited land of city can't meet the growing needs of people. As a result, people look to the countryside or rural and city at the junction of smallproperty right. It is because the characteristics of small property right and low price that lead to the expanding the scale of the small propertyright and the small property right transfer contract. Without three complete certificates, small property right is not stipulated by the state. Sothe user does not take ownership of small property right. It is necessary to discuss the effectiveness of the small property right transfer contract.
