| 摘 要： | 文章认为，我国的暂住证制度具有行政确认与行政许可双重法律性质，并具有前置许可的某些作用，因而该制度在现行条件下不具有正当性、合理性及合法性。暂住证制度存废的真正命运系于现行的户籍制度，其彻底废除的可能性根源于户籍制度的进一步改革，只有中国的户籍制度得到符合时代的改革，暂住证问题自会迎刃而解。

| Abstract: | The temporary dwelling card system have administration confirm permit double legal nature with the administration, and have leading some function that permit, therefore this system does not have proper, rationality and legitimacy under current terms. The system of the temporary dwelling card stores the real destiny that abolishes by the current household register system, its reforming furtherly in system of the household register of possibility origin abolished completely,only the household register system of China gets the reform which accords with the times,the issue of the temporary residence permit will be easily solved. |
