| 摘 要： | 按照部分学者的观点,贩卖毒品罪的本质属性是客观上使毒品发生流转,只要使毒品流通,一般可将该行为认定为贩卖毒品罪。事实上,这样的认定有违刑法谦抑原则,而且过于武断,以此将互易毒品行为、用毒品与其他非物质利益进行交换的行为、居间介绍买卖毒品的行为、委托他人代购毒品一概以贩卖毒品罪来论处,有失偏颇。

| Abstract: | In accordance with the views of some scholars,the essential attribute of the crime of drug trafficking is an objective place on the transfer of drugs,as long as the flow of drugs,generally can be identified as the behavior of drug trafficking crime.In fact,this principle finds a violation of criminal law,and too arbitrary in order to conduct the reciprocal drug,with drugs and other nonˉmaterial interests of the behavior of the exchange,acts as intermediary,the drug trade,drug Yigai commissioned shopping to drug trafficking crimes to be punished. |
