| 摘 要： | 继承作为一项重要的民事制度与人们的社会、经济、文化、家庭生活息息相关,作为取得财产的重要方式,历来为人们所重视,在司法实践中绝大多数的继承纠纷源于继承人对遗产的争夺,但是放弃继承在实践中亦不鲜见,当遇有继承人放弃继承时,是否会侵害了他人的共同财产,常有争议;我国关于继承权放弃的司法较为抽象和原则,实务中缺乏可操作性,有必要对继承权放弃的相关问题进行探讨。
