| 摘 要： | 信息披露和后续侵害是人肉搜索中的核心法律问题，在私法上主要涉及到对人格利益的侵犯。在我国现行人格权法体系下，基于名誉权、肖像权的救济具有局限性，基于隐私权的救济则更具普适性。现行法上对隐私利益的二元保护模式构成了对人内搜索侵犯人格利益之主要救济方式。

| Abstract: | The disclosure of information and follow-up infringement is the core legal issue in the human flesh search. In the civil law it is mainly related to a violation of the personality rights. Under China＇s current legal moral right system, accompanying with the imitated relief for the right of reputation and portrait, the relief based on the right to privacy is even more universal. Under the existing principal law, as the mainly remedy-the dual protected mode on the privacy interests constitutes the protection against the violation of personal interests in human flesh search. |
